Kinetic Servers Privacy Policy, Terms of Use and Refund Policy
Internal Uses
We use the information we collect about you in order 1) to provide our services and process your orders, 2) to provide customer service, 3) to improve our products and services. At your option we use the information you provide to access specific third party services on your behalf and perform the actions that you request us to perform, such as setting up financial gateways.
We give access to individually identifiable information about our customers only to those employees who require it to fulfill customer service requests. Your credit card number, bank account and other financial information will NEVER be revealed to anyone, except if we are required to do so pursuant to a subpoena or other legal process.
Disclosure to Third Parties Other Than Kinetic Servers Customers
Kinetic Servers will not sell or rent any of your personally identifiable information to third parties. Kinetic Servers will not share any of your personally identifiable information with third parties except in the limited circumstances described below, or with your express permission. These third parties are limited by law or by contract from using the information for secondary purposes beyond the purposes for which the information is shared.
If you go into a negative balance and owe us money, we may share information with processing companies including collection agencies.
We disclose information that we in good faith believe is appropriate to cooperate in investigations of fraud or other illegal activity, or to conduct investigations of violations of our Agreement. Specifically, this means that if we conduct a fraud investigation and conclude that one side has engaged in deceptive practices, we can give that person or entity’s contact information (but not bank account or credit card information) to victims who request it.
We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action.
We disclose information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).
We share aggregated statistical data with our business partners or for public relations. For example, we may disclose that a specific percentage of our users live in California. However, this aggregated information is not tied to personally identifiable information.
As with any other business, it is possible that Kinetic Servers in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by Kinetic Servers, including customer account information.
Contacts with Kinetic Servers Customers
We communicate with customers on a regular basis via e-mail to provide requested services, and we also communicate by phone to resolve customer complaints or order details. We use your e-mail address to send information about important changes to our products and services, and to send notices and other disclosures required by law. Generally, users cannot opt out of these communications, but they will be primarily informational in nature rather than promotional.
We also use your e-mail address to send you other types of communications that you can control, including the Kinetic Servers newsletter.
Internet Address Information We use IP addresses, browser types and access times to analyze trends, administer the site, improve site performance and gather broad demographic information for aggregate use.
Information Security
The security of your Kinetic Servers account also relies on your protection of your username and password. We strongly urge that you never share your username and password with anyone. Kinetic Servers employees will never ask you for your password, so any e-mail or other communication requesting your password should be treated as unauthorized and suspicious. If you do share your username and password with a third party for any reason, the third party will have access to your account and your personal information, and you may be responsible for actions taken using your username and password. If you believe someone else has obtained access to your username and password, please change it immediately by logging in to your account at www.yourdomainname.com/cpanel and changing your Profile settings. If you need to change your FTP/CPanel password please notify us of the change as we keep a secured updated list of all our user accts and we must have access to your cpanel/FTP acct to make changes or perform maintainence. If we find we cannot access your account to perform changes or maintainence we will change your password to the last one we have on file from our hosting control center and notify you of the change.
Password Security
Kinetic Servers has a 0 tolerance for weaak passwords. Using weak passwords compromises the security of everyone who is hosted on the server. We have seen and dealt with attacks that stemmed from a single user who used a weak password whereby over 50,000 spam emails were generated and were sent thru the server this did not happen on our server but one we maintained where security was a non issue meaning they did not care about the security of their hosted customers. At Kinetic servers we do care! and security of your data and intellectual property is of paramount importance that we have adopted this zero tolerance policy regarding weak passwords. We simply will not tolerate their use and any user caught using a weak password or changing a strong password to a weak one for ease of use will be subsequently removed from the server no questions asked and if said user is seen to have compromised the email reputation or other security area of the server they will be assessed a minimum of $500 security fee to cover our time in requesting RBL and CBLs black lists to remove the sever from their black list so that the remaining hosted customers can continue to do business via email with assurance their email will in fact be delivered. Your cPanel access includes methods for generating strong passwords and if you elect to have us create new email accounts or other secured access we will use strong passwords. If you need a website to help you generate a stong password you can use this free site to generate a strong password: https://strongpasswordgenerator.com/ Kinetic Servers does in fact have tools to check on the strength of passwords in use server wide and makes periodic checks using these tools… Again ANY user who is caught using a weak password for any area will have that domains account terminated.
A strong password has:
- at least 12 characters
- uppercase letters
- lowercase letters
- numbers
- symbols, such as ` ! ” ? $ ? % ^ & * ( ) _ – + = { [ } ] : ; @ ‘ ~ # | \ < , > . ? /
A strong password is not:
- your login or username
- your name, your friend’s name, your family member’s name, or a common name
- a dictionary word
- like your previous passwords
- your date of birth
- a keyboard pattern, such as qwerty, asdfghjkl, or 12345678 year or other dates
CANCELLATIONS – REFUNDS
Once work has begun on a project NO refund of any sort is implied. If cancellation of the project by the client or Kinetic Servers for reasons stated in the client agreement i.e. failure to comply with any stipulation codicil or abridgement of the agreement all original works belonging to the client will be returned and deleted from Kinetic Servers Hard Disks. There is never a refund. If a web site project has been completed and the final payment has not been made within a reasonable or stipulated time Kinetic Servers reserves the right to suspend then terminate the hosting account and retain ownership of all site files till payment has been made.
